The Biggest Shift in NC Imaging Regulation in Decades
As part of North Carolina’s 2023 Medicaid expansion legislation (House Bill 76), the General Assembly repealed Certificate of Need requirements for MRI scanners in counties with populations over 125,000 — a change that takes effect in November 2026. Until now, adding an MRI scanner in North Carolina required state approval through one of the country’s most restrictive CON programs.
- The approval barrier disappears. In qualifying counties, organizations will no longer need a Certificate of Need to acquire an MRI scanner — no application cycles, no need determinations, no waiting on the State Medical Facilities Plan.
- It applies to NC’s biggest markets. The 125,000-population threshold covers the state’s major metro counties — the Charlotte, Raleigh–Durham, Triad, Wilmington, and Asheville markets among them.
- MRI is the clean opportunity. PET scanners and several other services remain under CON review — which makes MRI the modality where preparation now translates directly into capacity later.
Health systems, physician groups, and imaging entrepreneurs across the state are working through the same math right now: demand for MRI in North Carolina’s growing metros already outpaces supply. When the restriction lifts, the advantage goes to whoever can add capacity fastest.
